CONSITEK - PRIVACY POLICY

INFORMATION FOR USERS OF THE SITE AND CONSITEK SRL AND CONSITEK SAGL CUSTOMERS

This information is addressed to all those who interact with Consitek srl e  Consitel Sagl (which we will define "Consitek" from here on) -  through the site page  https://www.consitek.com , corresponding to the home page of the official website of Consitek.

This page describes the methods of processing the personal data of users who consult and subscribe to the services on our website and interact via web, email or other telematic tool with our organization.

1)           IDENTITY OF THE DATA CONTROLLER

Data Controller: is the company Consitek srl, having its registered office in  Piazza del Duomo, 16 Milan (MI) Italy; pec: amministrazione@pec.consitek.com .

The company that develops and manages the portal referred to on our site, qualified and designated as data processor, is Consitek srl, with registered office in  Piazza del Duomo, 16 Milan (MI) Italy.

The list of all data processors can be consulted at the company headquarters.

Consitek srl acts on its behalf.

The treatment is always based on principles of lawfulness and correctness in compliance with all current regulations and suitable security measures are adopted to protect data.

 

2)         PURPOSE OF THE TREATMENTS

A) Personal data we collect through telematic / telephone services

Personal data for subscriptions to our newsletter, in which, with prior consent, we request simple contact details through the format on the page of our website (name, surname and email);

Personal and contact data for registration to the events that Consitek organizes, acquired through the various forms present on the various pages of our website or on other external sites specialized in this type of activity, to which the site automatically refers for the compilation of the forms ;

Personal contact data for information on our activities and services through the various contact forms on the site or through the chat integrated within the site itself;

Personal data obtained through requests for information made via email to the various addresses with domain @ consitek.com (by way of example, but not limited to:  marketing@consitek.com,  info@consitek.com, etc.) or to the corresponding PEC address.

Personal data obtained as a result of telephone calls received, made by potential customers to request information or insights on products / services offered by Consitek.

These data may be used, with explicit consent, for the purpose of sending newsletters, commercial information or advertising material or for direct sales purposes or for carrying out market research or interactive commercial communication.

All data are minimized to those relating to the forms present in the relevant sections of the site.

B) Personal data we collect for the provision of our services

Personal data for the establishment and execution of the contractual relationship and for the fulfillment of the related regulatory obligations (Article 6 letter b GDPR) obtained during the commercial negotiation with the customer and during the provision of services.

These data may be used, with explicit consent, for the purpose of sending newsletters, commercial information or advertising material or for direct sales purposes or for carrying out market research or interactive commercial communication.

The provision of data is necessary to achieve the aforementioned purposes and failure to provide the data would not allow the establishment of the contractual relationship. Moreover, for the treatment related to these purposes, the law does not require your consent.

C) Personal data deriving from the management of curricula

The Company reserves the right to evaluate the curricula received spontaneously or following the publication of announcements for potential candidates.

However, the kind candidates are invited to respect the following rules in the transmission of curricula in electronic format:

Respecting the European format in the compilation of their curriculum;

By sending the curriculum in pdf format;

Avoiding entering sensitive data in one's curriculum vitae (relating, in particular, to the state of health, religious, philosophical or political beliefs) that are not relevant in relation to the job offer;

By giving consent to the processing of sensitive data relevant to the establishment of an employment relationship (for example belonging to protected categories).

The Company will be responsible for providing suitable information to candidates during any interviews.

The purpose of the processing related to the management of the curricula will involve activities strictly related to the evaluation, recruitment or selection of personnel, with the objectives of collaboration, temporary or permanent employment, internships or theses.

D) Data provided voluntarily by sending emails

The optional, explicit and voluntary sending of e-mails to the various addresses with the domain @ consitek.com (by way of example, but not limited to:  marketing@consitek.com,  info@consitek.com, etc.), or at the corresponding PEC address, involves the subsequent acquisition of the sender's address, necessary to respond to requests, as well as any other personal data included in the message.

E) Information we collect from third parties

On the occasion of the organization of events, we collect the personal data and email contact details of the beneficiaries from third parties, who are guaranteed the right to cancellation.

Similarly, we may also collect personal data from social media services consistent with your settings on those services. We can add this information to what we already have in the archive and share it with others on the basis of what is established in this Notice.

 

F) Navigation data

The computer systems and software procedures used to operate our website acquire, during their normal operation, some personal data whose transmission is implicit in the use of internet communication protocols. This information is not collected to be associated with identified interested parties, but which by their very nature could, through processing and association with data held by third parties, allow users to be identified.

This category of data includes the IP addresses or domain names of the computers used by users who connect to the site, the URI (Uniform resource Identifier) addresses of the requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error ...) and other parameters relating to the operating system and the user's computer environment.

These data are used only to obtain anonymous statistical information on the use of the site and to check its correct functioning and are deleted immediately after processing (see our  Cookies Policy). The data could also be used to ascertain responsibility in the event of hypothetical computer crimes against the site.

 

3)         METHOD OF TREATMENT

The processing of your personal data is carried out by means of the operations indicated in art. 4 n. 2) GDPR and more precisely: collection, registration, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, cancellation and destruction of data. Personal data are subjected to both paper and electronic and / or automated processing. The processing operations are implemented in such a way as to guarantee the logical, physical security and confidentiality of your personal data.

4)         NATURE OF PERSONAL DATA

Your personal, common data relating to the performance of the above activities are the object of processing and the purpose has been specified. As for any particular, sensitive and health data, their minimization is guaranteed, i.e. their collection, use, protection and storage only in cases of absolute necessity and relevance with respect to the purpose and subject to the release of free informed consent.

5)         COMPULSORY OR OPTIONAL NATURE OF THE PROVISION

Apart from what is specified for navigation data, the user is free to provide personal data. Failure to release prevents access to some services, such as, but not limited to, the receipt of the newsletter, access to restricted areas of the site or confidential content or the establishment of contractual relationships and the consequent provision of services. Voluntary registration to the newsletter, by entering your data, implies in itself an explicit and unequivocal consent of the interested party to the processing of their personal data on the basis of the privacy policy of the site from which you proceed with the registration (there will in any case be requested to accept this information) or by signing specific documents.

The interested party can refuse to give the Data Controller the navigation data; to do this, he must disable cookies by following the instructions provided by the browser in use as per the separate cookie policy . Disabling cookies can make navigation of the site's features worse.

6)         SCOPE OF COMMUNICATION AND DISCLOSURE OF DATA

The data transmitted to Consitek are processed exclusively by personnel officially appointed and trained in matters of confidentiality and security of personal data.

We disclose your data to third parties only in these circumstances:

On the occasion of events, the list of participants with the sole indication of the name, surname and company they belong to (without other contact details such as emails or telephones) is communicated to the main sponsor for our legitimate interest in the correct and profitable financing of the activities and their commercial success also in the interest of the interested parties; the same information can be communicated through our website and other tools and means of communication (for example, without limitation, magazines, printed and online, press releases, press agencies, etc.).

By order of the Public Authority.

Any of these disclosures of information by us to third parties will only be made under the condition that we maintain a confidential state, so that this information is used only for the purposes for which it was disclosed.

7)         PLACE OF PROCESSING AND TRANSFER OF PERSONAL DATA TO A THIRD COUNTRY

The management and storage of personal data will take place on servers within the European Union and the data will not be transferred outside the European Union.

In some situations, when the user is redirected to external sites for the execution of particular services (such as, by way of non-exhaustive example, registration for events, or to the Consitek social channels to which the site is directed, etc.) , registration takes place on external servers and each of these services exposes its own policies, which could also derogate from what is written and transfer data outside the European Union.

8)         METHOD AND DURATION OF STORAGE OF PERSONAL DATA

The Data Controller will process personal data:

  • For the entire duration of the subscription services and the subscription to the newsletter

  • 10 years for the purpose of keeping accounting documentation pursuant to art. 2220 cc

  • 10 years marketing, subject to revocation of consent and cancellation of the Newsletter

9)         RIGHT OF ACCESS OF THE INTERESTED PARTY (art.15 GDPR UE 679/2016)

The interested party has the right to obtain from the data controller confirmation as to whether or not personal data concerning him is being processed and, in this case, to obtain access to personal data and the following information:

The purposes of the processing;

The categories of personal data in question;

The recipients or categories of recipients to whom the personal data have been or will be communicated, in particular if they are recipients of third countries or international organizations;

The retention period of the personal data provided or, if this is not possible, the criteria used to determine this period;

The existence of the right of the interested party to ask the data controller to rectify or delete personal data or limit the processing of personal data concerning him or to oppose their treatment;

The right to lodge a complaint with a supervisory authority;

The existence of an automated decision-making process, including profiling and, at least in such cases, significant information on the logic used, as well as the importance and expected consequences of such processing for the data subject.

10)       WITHDRAWAL OF CONSENT

With reference  to art. 6 of the GDPR 679/16, the interested party can revoke the consent at any time.

11)       OTHER RIGHTS OF THE INTERESTED PARTIES

With reference to the following standards  of the GDPR 679/2016:  art. 16 "right of rectification", art. 17 "right to cancellation", art. 18 "right to limitation of treatment", art. 20 "right to portability", Article 21 "right to object to the automated decision-making process", the interested party exercises his rights:

By writing to the Data Controller a registered letter with return receipt to the following address: Piazza del Duomo, 16 Milano (MI) Italy

Or by sending a pec to: amministrazione@pec.consitek.com .

Any violations of personal data, pursuant to art. 33 "Notification of a personal data breach to the supervisory authority", can be reported to the email address: info@consitek.com.
Data and information on the treatments can then be requested from the data controller to his email box  info@consitek.com, as required by the GDPR.

12)       PROPOSITION OF COMPLAINTS

The interested party has the right to lodge a complaint with the supervisory authority of the state of residence.

13)       AUTOMATED DECISION-MAKING PROCESSES

The Data Controller does not carry out treatments that consist of automated decision-making processes that involve profiling, or an action that may have a significant effect on the rights and prerogatives of the data subjects.

14)       INFORMATION NOT CONTAINED IN THIS POLICY

More information in relation to the processing of Personal Data may be requested at any time from the Data Controller using the contact information.

15)       CHANGES TO THIS PRIVACY POLICY

The Data Controller reserves the right to make changes to this privacy policy at any time by giving notice to Users on this page. Therefore, please consult this page often, referring to the date of the last modification indicated at the bottom. In case of non-acceptance of the changes made to this privacy policy, the User is required to cease using this Application and may request the Data Controller to remove their Personal Data. Unless otherwise specified.

16)       THE PRIVACY OF MINORS

Our website is aimed at a general public and does not offer services aimed at children. If we discover that a minor has provided us with personal data without parental or guardian permission, we will immediately delete this information.

17)       EXTERNAL LINKS

If pages of this website or sections of our applications contain links to other sites, they are not bound by this Privacy Policy. We recommend that you carefully read the privacy policy available on these external sites and examine the procedures for the collection, use and disclosure of the personal information they use.

18)       DEFENSE IN JUDGMENT

The User's Personal Data may be used for the defense by the Owner in court or in the stages leading to its eventual establishment, against abuses in the use of the same or related services by the User.  Following a court summons, judicial order or other legal initiative; in order to establish or exercise the rights recognized to us by law; to defend ourselves in the event of legal action against us or for other purposes dictated by law. The User declares to be aware that the Data Controller may be required to disclose the Data upon request of the public authorities.

19)       LEGAL REFERENCES

This information has been prepared in fulfillment of the obligations established by the GDPR 679/16 by art. 10, of the Directive n. 95/46 / EC, as well as the provisions of Directive 2009/136 / EC on the subject of Cookies.
